These Terms and Conditions (“T&C”) govern your use of our online platform, connecting you to a world of fashion and convenience in India; by accessing or using our website, you agree to comply with these terms for an enjoyable and secure shopping experience. These electronic documents are prepared in accordance with the Information Technology Act of 2000 and published in compliance with Rule 3 of the Information Technology (Intermediaries guidelines) Rules, 2011. 

All the copyrights are owned by the proprietor and this platform is a property of our proprietor. Our registered office is located at Flat No. 1202, C – Building Shiva Heights, Behind Shiwar Garden Restaurant, Shiwar Chowk, Rahatni, Pune 411027, Maharashtra, India. 

By using our platform (products, tools, services, features etc.) you automatically agree that you are in contract with the proprietor that you are bound by all the obligations mentioned in our terms & conditions, policies, privacy policy and other legal documents. 

At our sole discretion, we reserve the exclusive right to modify, alter, append, or remove sections of these Terms of Use without any prior written or other notice to you. It’s your responsibility to periodically review these Terms of Use for any updates or modifications. Your continuous use of the platform, subsequent to the posting of alterations, implies your acceptance and consent to these changes. As long as you adhere to these Terms of Use, we extend to you a personal, non-exclusive, non-transferable, limited privilege to access and utilize the platform. By either implicitly or expressly agreeing to these Terms of Use, you also agree to be bound by YUNEGR.in Policies, which include Privacy Policy and other legal documents subject to periodic amendments.

In accordance with these Terms of Use, the terms “You” or “User” pertain to any individual or legal entity that, by registering on the Platform as a Registered User, has consented to participate as a buyer and has provided relevant information. The terms “YUNGER.in,” “We,” “Us,” and “Our” refer to proprietor and their affiliates.

1. User Security:

While using the platform, you will be solely responsible for keeping your confidential information  safe, such as usernames, emails, passwords and other personal and sensitive information if there is any. You also agree that any wrong, inaccurate, untrue or incomplete information gives us the right to indefinitely suspend or permanently delete your account/membership on our platform. 

In case of compromized accounts or passwords or sensitive personal information you must immediately inform YUNGER.in customer service through appropriate channels that are conveniently setup on our platform. 

2. Services: 

YUNGER.in offers several products (physical and virtual). These products may be subject to several specific terms & conditions and policies such cancellation, return, exchange policies etc. Some of these policies have their own dedicated electronic documents and some of these policies are mentioned and described in the FAQ section. All these policies are integrated here by reference. 

When returning the product, users must ensure that the returned product is unused and retains its original tags and condition. If the returned product is used, damaged, or missing its original tags, the user’s return request will be denied, and the product will be re-shipped to the customer and the returned shipment might also attract additional shipping changes towards the customer. If the return request is declined, the user won’t be eligible for a refund, and YUNGER.in disclaims liability in such cases. Moreover, if the user fails to accept the re-shipped product, eligibility for a refund is forfeited, and YUNGER.in holds no liability for the return or refund of the re-shipped product.

Additionally, specific conditions tied to individual products might further complement these Terms of Use; these conditions will be displayed alongside the respective product.

YUNGER.in cannot guarantee the accuracy, completeness, reliability, currency, or error-free nature of product descriptions or other content on the platform, and YUNGER.in disclaims liability regarding this matter.

3. Transaction and Communication: Terms and Conditions:

YUNGER.in cannot be, is not and will not be in any way the party of any association in the interaction between two users or customers and vendors. Hereafter: 

1. Commercial and/or contractual terms: 

– All commercial/contractual terms are solely negotiated between Buyers and Sellers. These terms encompass price, shipping costs, payment methods, delivery details, warranties, and after-sales services.

– YUNGER.in does not advise, control, or engage in determining these terms between Buyers and Sellers.

2. Representation and Warranty:

– YUNGER.in makes no representations or warranties regarding the specifics (quality, value, etc.) of products or services listed on the Platform.

3. Non-Performance or Breach:

– YUNGER.in is not responsible for any breach of contract or evasion, negligence or non-performance between buyers and sellers on it’s platform

4. Rights and Liabilities:

– YUNGER.in does not hold any rights or any interests in the products and services provided by the sellers and hence hold no obligations of any liabilities concerning transactions and contracts between buyers and sellers

5. Use of YUNGER.in Platform:

– Our website is merely a platform for widening user’s reach for buying and selling operations  

6. Products And Services Availability:

– YUNGER.in is not in any way responsible for unavailable products and services from sellers. Complications arising due to this does not make YUNGER.in liable in any manner. 

7. Pricing Errors:

– Technical malfunctions, technical failures, typographical mistakes and other human errors regarding products offered by sellers may cause faulty prices to be displayed on the platform pages which may lead to order cancellations by sellers to prevent potential loss. 

– YUNGER.in is not responsible in these cases

8. Indemnity:

– All users release and indemnify YUNGER.in and all it’s representatives from any consequences emerging from user’s behaviour on the platform. You waive your right to do so under applicable laws.

9. Content Moderation: 

– We at YUNGER.in constantly strive to moderate the information provided by our users on our platform but we do not claim to have complete control over the content provided by the users. 

4. User Rules And Responsibilities:

1. Respect for User Data:

– You must not modify, steal, misuse, or exploit other users’ data, including personal information, transaction history, and communication records.

2. Appropriate Content:

 – Do not post objectionable, offensive, defamatory, discriminatory, or harmful content. Maintain a respectful tone and consider diverse perspectives.

3. No Spamming:

– Refrain from engaging in spamming, which includes unsolicited promotional messages, repeated content, or excessive linking.

4. Rights of Others:

– Respect the rights of others. Do not infringe upon trademarks, patents, copyrights, or any intellectual property rights.

– Do not attempt to alter or compromise the integrity of others’ work or data.

5. Obscene and Harmful Content:

– Do not share or post explicit, obscene, or harmful images, text, or any form of data that may be offensive or disturbing.

6. Non-Interference:

– Avoid interfering with other users’ enjoyment of the platform. This includes avoiding disruptive actions, harassment, or any form of negative impact.

7. Liability and Loss Prevention:

– Your actions on YUNGER.in must not create liability for us or cause any kind of loss to other users, including financial, reputational, or legal losses.

8. Respect for Trademarks:

– Do not use trademarks, logos, or copyrighted content without proper authorization. Ensure that your content respects others’ intellectual property rights.

9. Avoiding Legal Consequences:

– Your actions must comply with all applicable laws and regulations. Engaging in illegal activities, including fraud, impersonation, or spreading malware, is strictly prohibited.

10. Integrity of YUNGER.in:

– Do not engage in actions that compromise the security, functionality, or integrity of YUNGER.in. Avoid hacking, unauthorized access, or any attempts to breach our systems.

11. Reporting Violations:

– If you come across violations of these rules, promptly report them to our support team. Your assistance helps maintain a safe environment.

12. Consequences of Violation:

– Violation of these rules may result in a range of actions, including warnings, content removal, account suspension, or legal measures as necessary.

13. Positive Contribution:

– Embrace the opportunity to contribute positively to the YUNGER.in community. Share insights, engage in constructive discussions, and respect others’ opinions.

14. Compliance with Policies:

– Adhere to YUNGER.in’s overall Terms and Conditions, Privacy Policy, and other relevant policies.

15. Integrity And Security of India:

– User’s shall also not engage in any activity of any sorts that might hurt India’s unity, security, integrity, sovereignty or it’s interests and friendly ties with foreign nations. 

Activities Considered Fraudulent or Potentially Loss-Making for YUNGER.in

1. Misuse of Others’ Data:

 – Unauthorized access to or misuse of other users’ personal information or transaction data.

2. Intention to Cause Harm:

 – Engaging in actions with the intent to harm the platform, other users, or the reputation of YUNGER.in.

3. No Reply to Payment Verification Emails:

 – Failure to respond to payment verification emails or providing incorrect payment-related information.

4. Excessive and Unwarranted Returns and Cancellations:

 – Repeatedly returning products or canceling orders without valid reasons, resulting in financial loss.

5. No Payment on COD Orders:

 – Opting for Cash on Delivery (COD) orders and refusing to make the payment upon delivery.

6. Refusal to Pay:

 – Refusing payment for products or services received without legitimate grounds.

7. Coupon Code Overuse:

 – Excessive use of coupon codes or exploiting discounts beyond fair and intended use.

8. Wrong Returns:

 – Returning products intentionally altered, damaged, or different from the originally purchased item.

9. Frequent Refund Requests:

 – Making frequent refund requests for orders with the intention of gaining financial advantage.

10. Grabbing and Running During Delivery:

 – Receiving a product from the delivery personnel and intentionally running away without making the payment.

Please note that these points provide a general understanding of activities that could be considered fraudulent or potentially loss-making for YUNGER.in. The platform reserves the right to take appropriate actions, including warnings, suspensions, or legal measures, against users engaging in such activities.

Fraudulent Order Classification:

1. For Commercial Purpose:

 – Orders suspected of being placed for resale or commercial gain rather than personal consumption.

2. Bulk Orders with Promo Codes:

 – Using promotional coupon codes to obtain discounts on bulk orders intended for resale.

3. Invalid Address Provided:

 – Orders with addresses that are incomplete, incorrect, or unverifiable.

4. Orders Placed Using Wrong Methods:

 – Placing orders through unauthorized methods, including unauthorized accounts, fraudulent payment methods, or impersonation.

5. Technical Malfunction or Loopholes:

 – Exploiting technical glitches or platform vulnerabilities to gain unfair advantages in placing orders.

6. Orders for Self-Consumption:

 – Ordering excessive quantities of a product without genuine intent for personal use.

Cancellation Without Notice:

Orders falling under these categories may be subject to cancellation without prior notice. YUNGER.in takes these measures to ensure fair and ethical usage of the platform and to maintain the integrity of the shopping experience for all users.

You are strictly prohibited from using “robot/bot”, “spider”, “deep link”, “page script”, any other “malicious code” of any sorts or other automatic devices, programs, algorithms or methods or any other such process that can be or used to access, modify, monitor or copy to any extent any part of the platform or it’s content. You are also prohibited from using any manual means to seek to replicate or replicate or bypass the platform’s structure or layout, aiming to gain information not intentionally provided by the platform. We retain the right to prohibit and take measures against such activities. 

Engaging in unauthorized access, password hunting, password mining, or any form of illegitimate attempts to breach the system’s security is strictly prohibited. These actions compromise the integrity of the platform, potentially leading to data breaches and unauthorized use of sensitive information. We maintain a zero-tolerance approach towards such activities and take stringent measures to safeguard our users’ data and the overall security of the platform.

Impersonation, or posing as someone else with the intent to deceive, is strictly prohibited on our platform.

Compliance under the Information Technology Act 2000, as well as the provisions of any applicable exchange control laws or regulations in force, alongside international laws, foreign exchange laws, and a spectrum of statutes, ordinances, and regulations—including, but not limited to sales tax/VAT, income tax, Octroi, service tax, central excise, custom duty, and local levies—constitutes an essential cornerstone of our platform’s framework. Users engaging in any activities within our platform are required to meticulously adhere to these diverse legal provisions. It’s noteworthy that solicitation of offers and participation in transactions within this platform are encompassed by these legal frameworks, reinforcing users’ responsibility to conduct their actions in alignment with these domestic and international legal standards.

The responsibility of providing accurate information regarding products and services is essential; it’s imperative not to exaggerate or attribute false qualities to them.

Users are prohibited from engaging in advertising or solicitation to prompt other platform users to buy or sell products or services. Such activities should not disrupt the normal user experience.

YUNGER.in assumes no liability for any content posted by users, including claims, appearance, damages, losses, or infringement of proprietary or third-party rights on the platform. This includes any tortious or other unlawful information shared by users.

YUNGER.in disclaims accuracy concerning product attributes like size, color, dimensions, finishing, material, etc., as ordered by the user. 

The YUNGER.in Return & Exchange Policy provides you the choice to return or exchange products bought on YUNGER.in within the stipulated return/exchange period (the specific number of days for return/exchange can be found on the Product Detail Page). For guidance on returning or exchanging a purchased item, kindly consult the “Orders & Returns” page. 

YUNGER.in Fair Usage Credit Section:

In our commitment to maintaining a fair usage environment, certain terms and conditions apply to credits issued on YUNGER.in. Please note the following:

1. Non-Exchangeable and Non-Transferable:

   – Credits issued under fair usage are non-exchangeable and non-transferable between accounts or users.

2. No Compensation or Conversion:

   – Fair usage credits are not convertible into cash or any other form of compensation.

3. Forfeiture of Coupons/Vouchers and Gift Cards:

   – In cases where fair usage credits are applied, any associated coupons, vouchers, or gift cards may be forfeited.

We encourage our users to make the most of these credits responsibly, adhering to these terms for a seamless and equitable experience on our platform.

5. YUNGER.in Platform Content Guidelines:

YUNGER.in acknowledges that it exercises no control over user-uploaded content, encompassing a diverse array of elements such as photos, text, graphics, user interface (UI), visual interfaces, trademarks, logos, sounds, and other forms of artwork. It is important to note that these materials may include content from third parties. YUNGER.in functions solely as an intermediary platform for facilitating transactions and interactions between users, essentially serving the purpose of the contract between parties involved. In line with Our Privacy Policy and in compliance with applicable laws, we retain the right to use the Content and its elements perpetually, encompassing promotional, advertising, and derivative work purposes across all forms of media, both existing and future.

Information Usage Conditions:

When engaging with our platform, please adhere to the following usage conditions for the information provided:

1. For Personal Use Only:

   – Information obtained from our platform is intended solely for personal use.

2. No Copy/Paste or Modification:

   – Reproduction, copying, pasting, or modification of information is prohibited without explicit consent.

3. No Broadcasting on Other Media:

   – Information may not be broadcasted or shared on other media platforms without authorization.

4. No Representations or Warranties:

   – No representations or warranties are provided for the accuracy or reliability of the information.

5. Eligibility Conditions:

   – Eligibility for certain offers may change if orders are canceled/returned, or if the minimum purchase threshold drops below a specified amount.

6. Void Cashback or Discounts:

   – In such cases, any cashback or discounted amount associated will be considered void.

7. Reserved Rights for Modification:

   – We retain the right to modify these terms and conditions as needed.

6. Liability and Warranty Disclaimer:

It is important to note that your use of our platform is at your own risk. YUNGER.in assumes no responsibility for the accuracy, reliability, or completeness of any information, content, or materials available on the platform. We do not guarantee uninterrupted or error-free access to our services, and we are not liable for any disruptions, delays, or technical issues that may arise.

Furthermore, YUNGER.in disclaims all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and freedom from computer viruses or other harmful components. We do not warrant the suitability, reliability, availability, timeliness, or accuracy of the platform’s content, products.

In no event shall YUNGER.in, its affiliates, partners, employees, or agents be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from your use or inability to use the platform, even if we have been advised of the possibility of such damages. You agree to indemnify and hold us harmless from any claims, losses, or liabilities arising out of your use of the platform or violation of these terms.

This disclaimer of liability and warranties is an integral part of our terms of use and applies to your use of YUNGER.in.

7. Vendor Terms, Rules & Responsibilities:

As a vendor on YUNGER.in, your engagement is governed by a set of terms and responsibilities to ensure a harmonious and lawful marketplace:

1. Registration Requirements:

   To become a vendor, comply with the registration process and provide accurate and complete information as requested.

2. Legal Requirements:

   Adhere to all applicable laws and regulations, ensuring your products and services meet legal standards.

3. Intellectual Property Rights and Infringement:

   Respect the intellectual property rights of others. Do not engage in any activity that infringes upon trademarks, copyrights, or patents.

4. Trade Secrets and Proprietary Rights:

   Safeguard trade secrets and proprietary rights. Do not share confidential information or proprietary methods.

5. Accurate Descriptions:

   Provide accurate and honest descriptions of your products or services. Misleading information is discouraged.

6. Privacy and Rights of Others:

   Respect public privacy rights and the rights of individuals. Do not share sensitive information without proper authorization.

7. Content Publication:

   Publish only content that adheres to our guidelines. Ensure that your offerings are placed in appropriate categories.

8. Multiple Listings:

   Avoid multiple listings of the same product or service. Maintain a clear and organized inventory.

9. Stock Maintenance:

   Maintain updated stock availability. Products listed should be readily available for purchase.

10. Product Description Matching:

    Ensure that the product description matches the actual product received by the customer.

11. Refund Agreement:

    Agree to refund policies as outlined. Timely and fair handling of refund requests is obligatory.

By embracing these vendor terms, rules, and responsibilities, you contribute to a positive and compliant marketplace experience for all participants on YUNGER.in.

8. Payment Liability and Responsibility:

While YUNGER.in strives to ensure seamless payment processes, there are scenarios where we cannot assume responsibility:

1. Lack of Authorization:

   – YUNGER.in is not liable for payment failures due to lack of authorization from the cardholder’s bank or financial institution.

2. Transaction Preset Limit:

   – Payments may fail if the transaction exceeds preset limits set by your bank. YUNGER.in is not accountable for such instances.

3. Payment Issues in Transaction:

   – In cases where payment issues arise within the transaction process, YUNGER.in cannot be held responsible.

4. Other External Factors:

   – Factors beyond YUNGER.in’s control, such as technical glitches, network outages, or banking system failures, may lead to payment issues for which we cannot be held accountable.

Please ensure you have taken necessary precautions and are aware of your bank’s transaction limits and authorization requirements before making payments on YUNGER.in.

YUNGER.in operates exclusively in Indian currency (INR) to ensure consistency and clarity in transactions. In this regard, vendors are obligated to furnish supporting documents for the authentication process. These documents, including identification and address proof, play a pivotal role in establishing the ownership of buyers by vendors. This verification process not only bolsters the platform’s integrity but also cultivates a sense of trust among users. By complying with these mandatory document submission requirements, YUNGER.in fosters a secure and reliable marketplace where buyers and vendors can engage in transactions with confidence.

Transactions involving buyers, vendors, and the payment system constitute a bipartite contractual obligation. This arrangement is established for the successful completion of transactions. It’s important to note that YUNGER.in operates solely as a platform facilitator in these transactions. Therefore, the platform holds no liability in cases of non-delivery, non-receipt, non-payment, or non-availability of after-sale services. This also extends to issues related to warranties, fraud, and concerns regarding the products and services listed on the platform.

By utilizing the YUNGER.in platform, you grant us the authorization to effectively collect, process, facilitate, and remit payments on your behalf. It’s important to understand that YUNGER.in operates as an independent contractor for all transactional purposes. However, we must emphasize that we neither possess control over nor bear liability for the services and products listed on the platform. Transactions completed through the platform are paid for using the integrated payment system. We wish to highlight that while we facilitate these transactions, we do not guarantee their completion. Furthermore, it is noteworthy that YUNGER.in does not hold responsibility for disclosing the identities of the involved parties.

YUNGER.in functions as an electronic facilitator for transactions, distinctly different from offering banking or financial services. We want to emphasize that our role is to enable smooth transactions rather than being a banking institution. Specifically, we facilitate transactions like Cash On Delivery (COD), ensuring the collection and remittance of funds through existing banking infrastructure and established systems. This encompasses a range of payment methods such as credit cards, debit cards, UPI, and electronic wallets, along with other present and future payment gateways authorized by the Reserve Bank of India (RBI). However, it’s important to note that YUNGER.in is not positioned as a trustee or fiduciary. Our engagement focuses solely on the electronic facilitation of transactions and the handling of transactional prices.

It’s important for buyers to understand the dynamics of our payment system. Initiating a transaction through this system leads to the formation of a legally binding and enforceable contract between the buyer and the seller. This pivotal step solidifies the commitment between both parties involved. Additionally, buyers should take note of the transaction fees associated with using the payment system. These fees are either payable to the seller or to the platform, depending on the specific transaction. Being aware of these details empowers buyers to engage with our payment system with clarity and confidence, ensuring a seamless and trustworthy transaction experience.

You as a buyer agree that any transaction should be in compliance with payment system Rules & Policies

Buyer shall duly notify the payment system via appropriate channels about the delivery of the products in timely manner wherever necessary. 

As a Buyer, should you not receive the Delivery within the agreed time frame stated in the Transaction or as outlined in the Policies, whichever occurs first, you retain the right to claim a refund of the Transaction Price – your sole and exclusive recourse. However, failure to initiate a refund claim via Platform features within the stipulated period would render you ineligible for a refund.

As a Buyer, it’s important to comprehend that the Payment Facility might not be entirely available for specific product/service categories or transactions, as indicated in the Policies. Consequently, in such cases, a refund for transactions involving those products or services might not be applicable to you.

With the exception of Cash On Delivery transactions, any refunds, if applicable, will be processed through the same Issuing Bank that received the Transaction Price, or through an alternative method available on the Platform, as per your preference.

Refunds for electronic payments will be facilitated via the payment facility, utilizing NEFT / RTGS or any other online banking / electronic funds transfer system endorsed by the Reserve Bank of India (RBI).

All banks may not support refunds. In this case alternate bank account details shall be asked to be shared with us. 

Refunds will be subject to conditions and will come with the option for YUNGER.in to take recourse in case of any misuse by the Buyer. We retain the right to ask for additional documents for verification. 

Refunds are contingent upon the Buyer’s adherence to the established Policies. YUNGER.in  holds the prerogative to set limits on the volume of Transactions or Transaction Price accepted from an individual Valid Credit/Debit/Cash Card/Valid Bank Account, or any other approved financial infrastructure, whether directly or indirectly through a payment aggregator or authorized by the Reserve Bank of India for payment support. Such limits are applicable across a specified timeframe and allow YUNGER.in to decline Transactions surpassing this threshold.

The right is reserved by YUNGER.in  to decline processing Transactions for Buyers with a history of questionable charges, including, but not limited to, violation of YUNGER.in agreements, breach of law, charges from the Issuing Bank, or policy infringements.

YUNGER.in  holds the authority to conduct appropriate checks before confirming the receipt of the Transaction Price or the Buyer’s commitment to pay in the case of Cash On Delivery transactions. Such checks are performed for reasons including security and other considerations, guided by YUNGER.in’s discretion. If YUNGER.in determines unsatisfactory creditworthiness, transaction genuineness, or any other pertinent reasons at its sole discretion, the right is retained to reject the receipt of the Transaction Price or the Buyer’s commitment to pay. It’s important to note that, as an illustration, the ‘Cash on Delivery’ payment feature may be disabled for specific account users at YUNGER.in’s sole discretion.

To ensure the security of the Transaction and Transaction Price, YUNGER.in reserves the right to postpone notification of payment confirmation – a communication to the Seller to dispatch the item – in situations deemed suspicious or for Buyers involved in high transaction volumes. Furthermore, in the event of Buyer engagement in any illicit activity or at the request of law enforcement officials, YUNGER.in may withhold the Transaction Price and opt not to alert the Seller for dispatch. In these circumstances, rather than refunding to the Buyer, the Transaction Price might be remitted to law enforcement officials as required.

Both the Buyer and Seller acknowledge that YUNGER.in assumes no liability for any damages, claims, or interests arising due to non-processing or delay in processing a Transaction or Transaction Price, especially in cases beyond YUNGER.in’s control.

Adherence to Legal Requirements:

In line with applicable regulations, should the Customer initiate a purchase amounting to or exceeding INR 2,00,000.00, the Customer must promptly upload a scanned copy of their PAN card on the Platform within a period of 4 days subsequent to the purchase. Failure to comply will result in the cancellation of the Customer’s purchase. It’s important to note that the PAN card submission requirement is a one-time occurrence; if previously submitted, re-submission is unnecessary. It should be duly noted that a mismatch between the Customer’s name and the name on the PAN Card will result in the cancellation of the Customer’s order.

Buyers and Sellers are obligated to adhere to all relevant laws, which encompass, but are not limited to, the Foreign Exchange Management Act of 1999, along with its associated regulations and notifications issued under it, in conjunction with the Exchange Control Manual as periodically issued by the Reserve Bank of India. Other laws encompassed encompass the Customs Act, the Information Technology Act of 2000 as amended by the Information Technology (Amendment) Act of 2008, the Prevention of Money Laundering Act of 2002 and its related regulations, the Foreign Contribution Regulation Act of 1976 and its accompanying rules, as well as the Income Tax Act of 1961 and the rules accompanying it, alongside the Export Import Policy stipulated by the Government of India. The duty of adhering to these laws pertains to the respective utilization of the Payment Facility and the YUNGER.in Platform.

9. Indemnification:
